FALL RIVER, Mass. (WPRI) — A judge has once again postponed Aaron Hernandez’s Boston double murder trial.

On Tuesday, a judge moved the trial date because he is waiting on a decision from the Massachusetts Supreme Court over a cell phone. Hernandez’s defense attorneys claim police investigating the murders illegally took possession of his phone.

The state’s high court will hold a hearing on the evidence seizure on Jan. 5.

Hernandez appeared in court Tuesday dressed in a white t-shirt and gray sweatpants. He is currently serving a life sentence for the murder of Odin Lloyd.

Hernandez is now facing charges for the shooting deaths of Daniel de Abreau and Safiro Furtado following a chance encounter at a Boston nightclub in 2012.
