(FOX Providence) - The Kim Kardashian breakup has been making headlines week after week. And with her ex, Kris Humphries, looking for an annulment, and Kim ready to divorce, the legalities of the two can be confusing.

"Annulment, if granted, means that the marriage never occurred in the eyes of the law, said local lawyer Mike Bottaro.

If a couple decides to go through the court process, it means the marriage did in fact occur.

"In this case, there's several ramifications in the distinction. In the court filing last week, Kris alleged fraud. And fraud is one of the grounds for giving an annulment, and although there were no further details in that court filing, according to reports, there is a very big confidentiality clause in the pre-nup agreement. If the divorce is finalized as a divorce, then Kris will be prohibited from talking about his relationship with Kim. on the other hand, if Kris wins and gets his annulment, he will then be free to discuss, i. e., profit off of his relationship with Miss Kardashian," explained Bottaro.

So, who's going to win the battle?

"I'd say whoever has got the more expensive lawyers. But in this case, they both have expensive lawyers, so the judge will do what they always do and go through the evidence, analyze the factors," said Bottaro .
