Warwick murder trial continues Friday

Judge denied defense's request for a mistrial

WARWICK, R.I. (WPRI) - The defense in a Warwick murder trial has asked the judge to declare a mistrial.

On Friday morning, lawyers for Tony Gonzalez claimed there were text messages that the suspect's ex-girlfriend, Patricia Delomba, deleted that they say would degrade her credibility.

Delomba testified for the prosecution earlier this week and while on the stand pointed to Gonzalez as the shooter.

The judge denied the defense's request for a mistrial.

Gonzalez is charged with the murder of 23-year-old Carl Cunningham, Jr.

Prosecutors say Gonzalez showed up to Delomba's Warwick apartment last year to confront her new boyfriend. Once inside, investigators say Gonzalez opened fire - shooting her friend seven times.

Cunningham was reportedly hiding Delomba's boyfriend, Matthew Chivers, in a closet to protect him.
