Gun evidence in trial not conclusive

WARWICK, R.I. (WPRI) -- The murder trial of Carl Cunningham resumed on Wednesday.

In court, a forensic expert as well as the medical examiner who described the fatal gunshot wounds of the murder victim took the stand.

According to testimony, the murder suspect Tony Gonzalez’s friend gave Gonzalez a ride to a Warwick home on the evening of the murder. Gonzalez had told his friend he was going to sell some pot, and came out about five minutes later.

Gonzalez’ friend reported that nothing seemed usual that night. They later went for drinks and Gonzalez left the table for about 20 minutes, before returning and then getting a ride home.

The medical examiner testified and revealed that Cunningham was shot seven times the night he was killed.

The weapon in the murder was never recovered, and neither was the gun that Tony Gonzalez owned.

A forensics expert who studied the bullets that were found at the scene, testified that they were from a 9 millimeter semi-automatic handgun, which is the same type of handgun believed to be owned by Gonzalez.

There is no conclusive evidence that the guns are the same.

The state could finish the case as early as Thursday.
