CRANSTON, R.I. (WPRI) -- A judge dismissed a DUI charge against Personal Injury Lawyer Brian Cunha in court Friday.
Cunha was pulled over by police in early September after police say he drove through a stop sign, and then stopped in the middle of an intersection. He pleaded not guilty to the charge.
On Friday morning, the judge dismissed the DUI charge in exchange for his pleading guilty to a charge of refusing a chemical test.
"In retrospect, I wasn't drunk, I wasn't intoxicated, I should've taken the breathalyzer test," he said following his court appearance.
His privileges to drive in Rhode Island have been suspended for nine months, which according to the Attorney General's office was three months more than the minimum suspension length.
September's arrest was not Cunha's first run-in with the law, as he was charged with DUI back in 1998 and again in 2000.
