PROVIDENCE, R.I. (WPRI) - The RI Supreme Court has denied an appeal from Kimberly Mawson.
The court says the motion is moot because Mawson has already been granted a new trial.
Mawson was convicted of killing her 19 month old daughter, Jade, in Warwick in 2007. But she was released last year after the lawyer for her ex-boyfriend, Daniel Fusco, claimed his client confessed to the crime.
The retrial will now move forward. A date has not yet been scheduled.
