PROVIDENCE, R.I. (AP) - The Rhode Island Supreme Court has upheld the conviction of a North Providence woman found guilty of second-degree murder in the death of her newborn daughter.
In a ruling released Thursday, the court rejected arguments from Julie Robat that prosecutors failed to show she acted with malice. That's a requirement for a conviction of second-degree murder. Robat was convicted in 2009.
Robat's child was found inside a plastic bag in her family home in October 2006. Prosecutors said Robat hid her pregnancy and then smothered the baby after delivering it at home.
Robat's lawyer said at trial that she passed out before delivering the baby and the infant died because of a medical problem involving the placenta.
Robat was sentenced to 25 years in prison followed by 20 years probation.
