NEWPORT, R.I. (AP/WPRI) - A Rhode Island judge has dismissed criminal charges against two men accused of toppling or smashing 238 gravestones at a Newport cemetery last year.
The charges against 20-year-old Andrew Fowler and 37-year-old Richard Mounts were dismissed because authorities have been unable to locate a third man in the case.
Prosecutors had intended to call 24-year-old Ramon Fulvi as a witness against Mounts and Fowler. A warrant has been issued for Fulvi's arrest. He is charged with grave desecration.
Prosecutors have the authority to re-file charges against Fowler and Mounts in the future.
Authorities estimated it would cost $50,000 to right the toppled gravestones and another $75,000 to repair or replace the damaged ones at Island Cemetery.
The cemetery has become a hangout for homeless people.
Volunteers have since been able to repair or reset almost all of the headstones.
