CRANSTON, R.I. (WPRI) - A Warwick woman convicted of killing her young daughter is now free on bail.
Kimberly Mawson was released from the Adult Correctional Institute Wednesday night around 5 p.m. She told reporters outside the prison that she was feeling 'very good.'
Mawson was granted $10,000 bail Tuesday as a judge considers granting her a new trial. She has spent the last three years there for the 2002 death of her 19-month-old daughter Jade. She was found guilty of Jade's murder in 2007 and sentenced to 35 years in prison.
However, new evidence surfaced last week that could implicate someone else in the crime. Richard Corley, the lawyer for Mawson's ex-boyfriend Daniel Fusco, came forward and reported that Fusco told him in 2002 that he was responsible for the child's death. As a result, the state Supreme Court ordered a judge to consider a new trial for Mawson.
In a statement released Tuesday night, Attorney General Patrick Lynch said the new evidence demanded close scrutiny, including why it took almost eight years for it to come to light.
Under the terms of her release Mawson must stay at her Connecticut home and she cannot leave Connecticut or Rhode Island without a judge's permission.
She is also prohibited from unsupervised contact with anyone under the age of 16.
