Docs reveal new details in Mawson trial

Judge considering new trial for Kimberly Mawson

WARWICK, R.I. (WPRI) - Convicted child killer Kimberly Mawson has been released on bail after serving three years for the death of her daughter.

A judge granted her bail after her ex-boyfriend's attorney came forward claiming his client confessed to the crime.

Now, documents uncovered by Eyewitness News show it's clear the Attorney General's office still believes Kimberly Mawson is guilty of killing her 19 month-old baby Jade in Warwick back in 2007.

In a motion to the Supreme Court filed earlier this month, prosecutors write:

"[The] State does not presently agree with Mawson’s suggestion that, based on the information disclosed to Supreme Court chief disciplinary counsel, Mawson would not have been convicted in this case."

Prosecutors go as far as calling the new information "hear-say" because it did not come directly from Mawson’s ex-boyfriend Daniel Fusco, but through his attorney, Richard Corley. The new information comes to light after Corley came forward saying Fusco confessed to the murder 8 years ago.

Corley was Fusco's attorney at the time. The documents also reveal prosecutors want Corley to meet with state investigators to disclose everything he knows about the case.

But Mawson’s attorneys write:
"Mr. Corley will certainly be required to testify at any hearing where both sides can examine him."

The state supreme court last week ordered that the Superior Court hear and decide Mawson's motion for a new tria l within six months.
