BOSTON (AP) - A Massachusetts judge has turned down a new trial request by the man who called himself Clark Rockefeller.
Christian Karl Gerhartsreiter was convicted last year of the 2008 kidnapping of his 7-year-old daughter and assaulting a social worker supervising their visit.
The Suffolk District Attorney's office said it got notice Monday of the Feb. 25 decision by the trial judge, Frank Gaziano.
Gerhartsreiter's lawyers say a prosecutor made an improper closing argument urging jurors not to be manipulated by the insanity defense. They also questioned the qualifications of a state psychiatric witness to discuss the insanity defense.
Defense attorney Jeffrey Denner said Monday he will appeal the decision, which was not unexpected.
Prosecutors said Gerhartsreiter used aliases in several states and told elaborate lies about his past. The defense said he was delusional.
