WARWICK, R.I. (WPRI) -- The murder trial continues in the shooting death of a man whom officials say was in the wrong place at the wrong time.

Tuesday was an emotional break for Carl Cunningham’s family, as forensics and evidence were key in the day’s trial.

A host of Warwick detectives took the stand on Tuesday, each describing how and when Tony Gonzalez was taken into custody.

“They kept asking him where the gun was, and he stated ‘It’s not here,’” said a detective.

The only evidence that was shown in court on Tuesday was an empty gun case, because the gun used in Carl Cunningham’s murder has never been found.

Detectives revealed that there was some evidence of gun residue on the defendant’s hands, but the test was inconclusive.

Gonzalez told police that he was home at the time of the shooting.

The defendant’s step brother also testified on Tuesday, saying he was with Gonzalez in the hours leading up to the murder.

Cunningham’s family has been present for each day of the trial, which so far has taken an emotional toll on the family.
