Conn. sues CVS over expired goods

HARTFORD, Conn. (AP) - Connecticut officials are suing CVS/Pharmacy Inc., alleging it has sold food and over-the-counter medications past their expiration dates at many of its Connecticut stores.

Attorney General Richard Blumenthal and Consumer Protection Commissioner Jerry Farrell Jr. say investigators found expired cough and allergy medicines, dairy products, baby formula, and other products at 20 stores in the summers of 2008 and 2009.

The lawsuit in Hartford Superior Court seeks unspecified financial penalties under state consumer protection laws.

Joanne Dwyer, a spokeswoman for Woonsocket, R.I.-based CVS, says it has clear policies about removing expired products from its stores. She said "unintentional deviations" are quickly rectified when they are discovered.
